I met my husband while he was working in Scotland and we got married in Scotland in July 2021. We applied directly to the London Embassy, straight after our wedding (on our honeymoon in fact) with an expedited case since my husband was repatriating with his company back to the US. We hired Flynn Hodgkinson immigration lawyers to help us with the filing and application process. We would highly recommend them! I had my CR-1 interview on 14th December 2021 at the US Embassy in London. All went well and I was told everything was in order and visa approved. We were told my passport would be sent to me in 7-10 working days. My husband and I planned to travel to Texas together after a family Christmas in Scotland. Christmas came and went and we figured there would be delays due to Covid and the holidays. So he travelled out there to start his new job on 2 January and I stayed with my parents in Scotland. Since my job required a 3 month notice period, I quit my job in December in preparation for the move. Another couple of weeks went by and our immigration lawyer got in touch to say that the Embassy had confirmed my case was undergoing additional administrative processing. My status on the CEAC tracker changed to Refused sometime in December. We saw a few case updates in early January but it eventually got stuck at 10 January. There was no request for additional information and my medical was sent to the Embassy a week before my interview. We have no criminal records, no visits to any countries on the watch list, no visa overstays, and we do not know why our case was red flagged. On Friday 25 February, we contacted our congressman’s office to try and move things along and we have also sent enquiries to the Embassy once a month through our lawyer. At this point, we had heard nothing and our status was still last updated on 10 Jan, so we’d been in admin processing for ~90 days. There was an update to our case 25 March. We finally heard back from our congressman’s enquiry that day, a stock response from the Immigrant Visa Unit to say we were still in admin processing and the process could not be expedited. We hoped this might help move things along. We had another similar response after our Congressman’s office chased again on 7 April, but no further updates to the case tracker. We set up an appointment with Mr Charles Kuck from Kuck Baxter Immigration for the Writ of Mandamus lawsuit on 10 May. We filed suit and the summons was mailed on 10 June. I requested my passport from the Embassy and attended a new medical on 13 June. I sent my passport back with DX straight afterwards. We finally saw case updates on 3, 4 & 5 August. On Monday 8 August, the status changed from Administrative Processing to Issued in the space of about an hour first thing that morning. The Mandamus worked for us, thankfully, after just shy of 8 months in the black hole of admin processing. I received the visa in hand on Thursday 11 August and flew to Texas to join my husband on Friday 12 August.
On arrival in Houston, I had no issues. The officer asked me for an address and phone number and they took the package that came with my passport which was marked ‘Do Not Open’. I want to send good thoughts to everyone that has had to experience administrative processing. It was a really challenging few months for us in our first year of marriage and we are so grateful to our legal teams for supporting us throughout. We have no idea how long it would take for our case to be looked at without the Mandamus. Thanks to the litigation, we are now looking forward to spending the rest of our lives together. 2022-08-16
